Terms of Service

1. Agreement to Terms

By creating an account or using GospelCall (“the Service”), you agree to be bound by these Terms of Service (“Terms”). The Service is operated by GospelCall (“we,” “us,” or “our”). If you are using the Service on behalf of a church or organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

GospelCall is an AI-powered phone answering service designed for churches. The Service answers inbound phone calls using artificial intelligence, provides callers with information from your church's knowledge base, routes urgent calls to designated staff members, and collects messages when staff are unavailable. The voice pipeline uses speech-to-text, AI language processing, and text-to-speech technologies to conduct natural conversations with callers.

3. Account Registration

To use the Service, a church administrator must create an account and complete the onboarding process, which includes providing church information, staff contacts, and a knowledge base. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate and complete information during registration.

4. Subscription Plans and Payment

The Service is offered through paid subscription plans with varying included minutes per billing period. Plans renew automatically at the end of each billing cycle. Payment is processed securely through Stripe. You authorize us to charge your payment method on file for subscription fees and any applicable overage charges.

Overage charges: If your call usage exceeds the minutes included in your plan during a billing period, you will be charged a per-minute overage rate as specified in your plan details.

Plan changes: You may upgrade or downgrade your plan at any time through the billing settings in your dashboard. Downgrades take effect at the start of your next billing period. Upgrades take effect immediately with prorated charges.

Cancellation: You may cancel your subscription at any time. Upon cancellation, your service will remain active until the end of the current billing period. No refunds are provided for partial billing periods.

Payment failure: If a payment fails, we will attempt to collect payment and provide a grace period before suspending service. During the grace period, calls will continue to be answered but usage may be limited.

5. Acceptable Use

You agree to use the Service only for its intended purpose of church communication. You may not:

  • Use the Service for any unlawful purpose or to facilitate illegal activity
  • Attempt to interfere with, compromise, or disrupt the Service
  • Use the Service to make outbound calls or for telemarketing
  • Provide false or misleading information in your knowledge base
  • Resell or redistribute the Service without authorization
  • Use the Service in a way that generates excessive or abusive call volume

6. AI-Powered Service Disclaimer

The Service uses artificial intelligence to process and respond to phone calls. While we strive for accuracy, the AI may occasionally misinterpret caller requests, provide imprecise answers, or fail to correctly route calls. The AI is not a substitute for human staff and is not designed to handle medical emergencies, legal advice, or counseling.

The quality and accuracy of responses depend significantly on the information you provide in your church's knowledge base. You are responsible for keeping this information current and accurate.

Emergency calls: The Service is not a replacement for emergency services. If a caller indicates a life-threatening emergency, the AI will attempt to direct them to call 911 and will route the call to your designated emergency contact, but this process is not guaranteed. You should ensure your staff contacts and transfer rules are properly configured.

7. Call Recording and Transcription

All calls handled by the Service are processed in real time using AI speech recognition and language processing. Conversation transcripts are generated and stored for your review. By using the Service, you acknowledge and agree to the following:

  • You are responsible for ensuring your configured greeting notifies callers that the call is assisted by AI and, where applicable, that the call may be recorded.
  • You are responsible for compliance with applicable call recording laws in your jurisdiction, including any additional disclosure requirements.
  • Call transcripts are stored in your account and accessible through your dashboard.
  • Voice audio is processed in real time by third-party speech services and is not permanently stored by GospelCall after processing.

Phone greeting responsibility. You acknowledge that the phone greeting you configure in GospelCall is the primary mechanism by which callers receive any required disclosures about AI call processing or call recording. You are solely responsible for the content of your greeting and its compliance with applicable law in your jurisdiction. GospelCall provides state-specific guidance in its dashboard for informational purposes only, and such guidance does not constitute legal advice.

8. Intellectual Property

The Service, including its software, design, and documentation, is owned by GospelCall and protected by intellectual property laws. You retain ownership of all content you provide, including knowledge base entries, church information, and staff contact details. You grant us a license to use this content solely to operate the Service on your behalf.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data and the data of your callers. By using the Service, you consent to the data practices described in the Privacy Policy.

10. Service Availability

We use commercially reasonable efforts to maintain high availability of the Service. However, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any damages arising from service interruptions.

11. Termination

We may suspend or terminate your account if you violate these Terms or engage in activity that is harmful to the Service or other users. You may terminate your account at any time by canceling your subscription and contacting us.

Upon termination, your right to use the Service ceases immediately. We will retain your data for a reasonable period to allow you to export it, after which it will be deleted in accordance with our Privacy Policy.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOSPELCALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FROM MISSED CALLS, MISROUTED CALLS, INACCURATE AI RESPONSES, OR SERVICE INTERRUPTIONS.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service dashboard. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
